These are the terms and conditions which apply to your purchase of jewellery, accessories and other goods (“item(s)”) from the Annabella Moore website at annabellamoore.com (the “site”). In these terms and conditions, "we", "us", "our" and Annabella Moore means Annabella Moore Ltd.

Please read these terms and conditions carefully before using the site. These terms and conditions form a legally binding contract between us and you. By placing your order with us, you are implicitly accepting these terms and conditions and also agree to the notices and disclaimers.

You must be 18 years of age or older to purchase item(s) from the site. If you are under 18, you may use the site only with the involvement of a parent or guardian. Your use of and registration on the site is void where prohibited.

By placing an order with annabellamoore.com you are agreeing to receive email newsletters from Annabella Moore. We will not share your data with any 3rd parties. If you wish to be removed from our mailing list at any point simply click on the unsubscribe link provided in any email.

We try to make sure that all information on the website, including descriptions of our item(s), and listed prices, are accurate and correct at all times. We will try to resolve all information errors on the website as soon as reasonably possible. 

We reserve the right to change these terms and conditions from time to time, and your continued use of the website (or any part thereof) following such change shall be deemed to be your acceptance of such change. It is your responsibility to check regularly to determine whether the conditions have been changed. If you do not agree to any change to the terms and conditions, then you should immediately stop using the site

 

Legal Governance

Your use of this site and any contract between you and Annabella Moore Ltd for the sale of item(s) shall be governed by and shall be construed in accordance with the laws of England and Wales and shall be subject to the non-exclusive jurisdiction of the Courts of England and Wales. If any provision of these terms and conditions shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms and conditions and shall not affect the validity or enforceability of any remaining provisions. If we fail to enforce a right under these terms and conditions, that failure will not prevent us from enforcing other rights, or the same type of right on a later occasion.

Unless otherwise stated in these terms and conditions, no part of these terms and conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.

 

Limitation of Liability

The description of the item(s), services, price, currency, VAT and delivery costs are set out on the checkout page. Your order is an offer and no contract of sale is formed between you and Annabella Moore Ltd until you receive the 'confirmation of order' email from us.  Orders shall be accepted at our sole discretion but are normally accepted once credit card authorisation has been confirmed.

The order reflects current pricing and stock levels that have been checked or, in the case of services, that we can offer the service you require. Once we accept your order, you shall pay the price for the item(s) or services plus VAT, delivery and other costs specified on the checkout page and we shall charge your account for payment. Please keep your "confirmation of order" e-mail for your records.

In exceptional circumstances, if we are not able to fulfil an order we have accepted, your credit card will be re-credited with the original price and we will notify you by email. Under no circumstances will we be liable for any indirect consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify us of due to this issue and we shall have no liability to pay any money to you by way of compensation other than to refund the amount paid by you for the item(s).

Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local laws or statutory rights that may not be excluded nor in any way to exclude or limit our liability to you for any death or personal injury from our negligence.


Photography

Some item(s) may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other item(s) may be represented at a larger than actual size in order to clearly show details or smaller than actual size in order to show the entire item.
Every effort has been made to illustrate colours accurately but this is not always possible with digital reproduction on different web browsing platforms. Hence, there can be no guarantee that the true colour of the jewellery will be exactly as shown.

Annabella Moore Ltd assumes no liability whatsoever for the topicality, correctness, completeness or quality of the information provided. All content is subject to change without notice. Annabella Moore Ltd expressly reserves the right to modify, supplement or delete parts or the entire content of this site, without prior advance notice, or to suspend or terminate the site.

 

Nature’s Whim

Many of our pieces feature natural materials, semi-precious stones, shell, fresh water pearls and so son. Colours, size and making will vary slightly from piece to piece.


Payment

We accept VISA, MasterCard, Switch and Maestro.

To securely receive your payments over the Internet we use Secure Sockets Layer (SSL) technology, which is the standard Internet practice and means your details are protected. Shopify is certified Level 1 PCI DSS compliant. This compliance extends to all online stores powered by Shopify.

 

Delivery and Customs

We will use our reasonable endeavours to deliver the order within the times indicated.  However, where delivery times and dates are given, they are for general guidance only. We cannot be held responsible for any delays once item(s) have left us and is in possession of the delivery carrier

We will not be in breach of this Agreement or otherwise liable for any delay in performance if to the extent that any delivery failure is due to circumstances beyond our reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

We shall attempt to deliver the order to the address you specify for delivery. You are responsible for making arrangements to receive the item(s). If the item(s) is held at the post office or other delivery company's depot because no one was available when the item(s) were delivered, then it is your responsibility to swiftly collect the item(s). It is important that the address supplied by you to us is accurate.

If you do not receive the item(s) you ordered within 7 working days, you will have to notify us by email or telephone within 14 working days from the day you ordered the item(s). We will hold no liability unless we are notified within this period of time.

Annabella Moore Ltd cannot guarantee that the sale and delivery of its item(s) to your particular country or location is permissible, so please be aware of your own geographic import restrictions. Please note that we are currently not able to deliver to addresses outside the territories stated, P.O. Boxes or military bases 

Customers must observe and comply with all applicable regulations and legislations, including obtaining all necessary customs, import or other permits to purchase goods from our site. Annabella Moore Ltd will not be held liable for any duty and/or administration charges on parcel delivered to overseas addresses. The importation or exportation of certain of our item(s) to you may be prohibited by certain national laws. We make no representation  and accept no liability in respect of the export or import of item(s) you purchase.

Returns and Exchanges

In the unlikely event that you are unhappy with your purchase, if the item(s) we delivery is not what you ordered or if it is damaged, defective or if the delivery is of an incorrect quantity, we will refund you the full value of the item(s). To exchange a product you will have to return the item to get a refund and then purchase your new desired item on the website.

You will need to fill out the Returns Form (download here) and email it to our Customer Care Team at customercare@annabellamoore.com within 7 working days of the delivery of the item(s). The item(s) must be sent together with the printed Returns Form to the return address stated on the form within 14 days. Please note that a £5 admin charge will apply to any item(s) that has a personalised message added on the website.

We request that all item(s) are returned in their original Annabella Moore packaging and in the condition in which they were received. We strongly advise all customers to check their purchase thoroughly upon delivery before removing any attached tags. We cannot accept returned item(s) that have been worn or removed from the cork attachment. For hygiene reasons, we regrettably cannot accept the return of earrings.

We recommend that you send the return item(s) with a trackable delivery service (eg. Royal Mail Recorded or Special Delivery) for your own protection. In the event of failure to return any item(s) to us within the time limits stated, we reserve the right to charge any costs of recovery admin charges, or refuse the refund or exchange. We shall have no liability to you for item(s) sent by you to the wrong address or lost in transit.

Regrettably, we cannot refund delivery costs, sales tax or customs duties payable for, unless you have been sent incorrect item(s) or if the item(s) is faulty or damaged. In that case, we will refund the price of the item in full, together with any applicable delivery charges including any reasonable costs you incur in returning the item(s) to us. 

A refund of the cost of the item(s) will be issued once all the conditions referred to above is received, and in any event no later than 14 days after we receive the item(s) from you. The credit card used for the original purchase will be credited with the original price. If you used vouchers to pay for the item(s) we will refund you in vouchers. If there are any problems with your refund, a member of our Customer Service Team will contact you.
